NextUp Labs, LLC (“NextUp,” “we,” “us,” or “our”) operates the NextUp platform and related services. NextUp is designed to help athletes build and manage their sports identity, showcase their athletic journey, and connect with the broader sports community.

We recognize that many NextUp members are young athletes, and protecting their privacy is an important part of how we design and operate the platform. This Privacy Policy explains what information we collect, how we use it, how it may be shared, and the choices available to athletes and families.

01Information We Collect

We may collect information that you provide directly to NextUp, including:

  • Name and date of birth
  • Email address and account information
  • Parent or guardian information
  • Profile photos and other images
  • Athletic information, including sports, positions, teams, clubs, jersey numbers, statistics, achievements, and athletic history
  • Academic information that you choose to include in a profile
  • Biographical information
  • Social media or external links you choose to provide
  • Videos, highlights, and other content you upload or link to
  • Connections and other activity within NextUp
  • Communications you send to us, including support requests and feedback

We may also automatically collect certain technical information when you use NextUp, such as device information, browser type, IP address, application activity, and information about how the platform is used.

02How We Use Information

We use information to provide, maintain, protect, and improve NextUp. This may include using information to:

  • Create and manage NextUp accounts and profiles
  • Generate and display athlete profiles and digital player cards
  • Enable connections within the NextUp community
  • Apply age-appropriate account experiences and privacy controls
  • Support parent and guardian oversight
  • Personalize and improve the NextUp experience
  • Operate, troubleshoot, secure, and analyze the platform
  • Communicate important account, safety, or service information
  • Respond to questions and support requests
  • Develop new features and services
  • Prevent fraud, misuse, or activity that could harm our members or the platform
  • Comply with applicable legal obligations

03Young Athletes and Family Accounts

NextUp provides different account experiences based on an athlete’s age.

Athletes Under 13

Athletes under 13 do not create independent NextUp accounts. Their profiles are created and managed through a parent or guardian account.

The parent or guardian controls the child’s profile and the information added to it.

Teen Athletes

Athletes ages 13 through 17 may have their own NextUp account while being linked to a parent or guardian.

NextUp provides guardians with oversight and controls that may include managing whether a teen can publish a profile or connect with other members without guardian approval.

Adult Athletes

Members 18 and older may independently manage their accounts, profiles, privacy settings, and connections.

04Profiles and Public Information

NextUp allows athletes and families to create sports profiles and digital player cards that may be shared with other people.

Depending on the visibility settings selected for a profile, information included in that profile may be visible to other NextUp members or to people outside of NextUp through a shared or public link.

You should only include information in a public or shareable profile that you are comfortable sharing with others.

Parents and guardians managing profiles for younger athletes should carefully consider what information they choose to make publicly available.

05How We Share Information

We may share information in limited circumstances necessary to operate NextUp, including:

With other users or the public.

Information included in profiles, player cards, or other shared areas may be visible according to the privacy and visibility settings associated with that content.

With service providers.

We may use trusted third-party companies to provide services such as hosting, data storage, authentication, communications, analytics, payment processing, and other technology necessary to operate NextUp. These providers may process information on our behalf in connection with providing their services.

For legal or safety reasons.

We may disclose information when reasonably necessary to comply with applicable law, respond to valid legal requests, enforce our policies, investigate fraud or misuse, or protect the rights and safety of NextUp, our members, or others.

In connection with a business transaction.

Information may be transferred as part of a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to applicable law.

We do not sell personal information in exchange for money.

06Privacy and Visibility Controls

NextUp provides controls that allow members and families to manage how athlete information is shared.

Available controls may vary based on account type and age and may include profile visibility, publishing permissions, connection permissions, and guardian approval requirements.

We may update these controls as NextUp evolves.

07Data Retention

We retain personal information for as long as reasonably necessary to provide the NextUp service, maintain accounts, meet legal and operational requirements, resolve disputes, and protect the platform.

Retention periods may vary depending on the type of information and the reason it was collected.

08Account and Data Requests

You may update certain information directly through your NextUp account.

You may also contact us to request assistance with accessing, correcting, or deleting your personal information or account.

For accounts involving minors, we may require the request to be made or confirmed by the parent or guardian associated with the account.

We may need to retain certain information when required by law or when reasonably necessary for security, fraud prevention, dispute resolution, or other legitimate business purposes.

09Security

We use administrative, technical, and organizational measures intended to protect information stored within NextUp.

However, no online service or method of electronic storage can guarantee complete security. Members should protect their account credentials and notify us if they believe their account has been accessed without authorization.

10Third-Party Services and Links

NextUp profiles may contain links to third-party websites or services, including social media platforms, team websites, video services, or other external resources.

NextUp does not control the privacy practices of these third parties. Information you provide to or share through third-party services is governed by their own privacy policies.

11Changes to This Privacy Policy

We may update this Privacy Policy as NextUp grows, new features are introduced, or legal requirements change.

When we make material changes, we will update the “Last Updated” date above and may provide additional notice when appropriate.
