Terms of Service

Welcome to NextUp. These Terms of Service (“Terms”) govern your access to and use of the NextUp platform and related services operated by NextUp Labs, LLC (“NextUp,” “we,” “us,” or “our”).
By creating an account or using NextUp, you agree to these Terms. If you are using NextUp on behalf of a child or another person you are legally authorized to represent, you agree to these Terms on their behalf as well.
01About NextUp
NextUp is a sports identity platform designed to help athletes build and share their athletic profiles, create digital player cards, document their athletic journey, and connect with people and organizations in the sports community.
NextUp may add, modify, or remove features as the platform evolves.
02Eligibility and Accounts
You must provide accurate information when creating or managing a NextUp account.
NextUp uses age-based account experiences.
Athletes under 13 may participate through profiles created and managed by a parent or legal guardian.
Athletes ages 13 through 17 may use NextUp with a linked parent or guardian and may be subject to guardian permissions and approval requirements.
Members 18 and older may manage their own accounts independently.
If you create or manage a profile for a minor, you represent that you are the minor’s parent, legal guardian, or otherwise legally authorized to create and manage the profile.
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.
03Athlete Profiles and Player Cards
NextUp allows members to create profiles and digital player cards containing athletic and other information.
You are responsible for ensuring that information you submit is accurate and that you have the right to provide and share it.
Some profiles or player cards may be publicly accessible or shareable through links depending on the privacy and visibility settings selected by the member or guardian.
You are responsible for reviewing these settings before publishing or sharing a profile.
04Your Content
You retain ownership of the photos, videos, text, athletic information, and other content you submit to NextUp (“Your Content”).
By uploading or submitting Your Content, you grant NextUp a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute Your Content as reasonably necessary to operate and provide the NextUp service.
This permission does not transfer ownership of Your Content to NextUp.
You represent that you have the rights and permissions necessary to submit Your Content and allow NextUp to use it as described in these Terms.
05Acceptable Use
NextUp is intended to be a positive and professional sports community.
You may not use NextUp to:
- Harass, threaten, bully, exploit, or impersonate another person
- Post content that is unlawful, fraudulent, abusive, discriminatory, sexually explicit, or otherwise inappropriate
- Misrepresent your identity, athletic history, credentials, affiliations, or achievements
- Create an account or profile for another person without authorization
- Attempt to circumvent age restrictions, guardian controls, privacy controls, or other safety features
- Collect, scrape, download, or systematically extract member information without authorization
- Use information obtained through NextUp for spam, harassment, exploitation, or other unauthorized purposes
- Attempt to gain unauthorized access to NextUp, another member’s account, or systems connected to the platform
- Introduce malware or otherwise interfere with the security or operation of NextUp
- Use NextUp in a way that violates applicable law or the rights of another person
We may remove content, restrict functionality, suspend accounts, or terminate accounts when we reasonably believe these Terms or our policies have been violated.
06Protecting Young Athletes
Members must respect the privacy, safety, and boundaries of young athletes using NextUp.
You may not use NextUp to exploit, groom, harass, solicit inappropriate contact with, or otherwise endanger a minor.
Attempts to circumvent guardian controls or other protections designed for minors may result in immediate suspension or termination and may be reported to appropriate authorities when required or appropriate.
07Connections and Interactions
NextUp may allow members to connect with other athletes and, as additional account types become available, coaches, trainers, organizers, teams, organizations, and other members of the sports community.
A connection on NextUp does not represent an endorsement, verification, recommendation, or guarantee by NextUp unless explicitly stated otherwise.
Members are responsible for evaluating their interactions with other users and exercising appropriate judgment when communicating or interacting with people they meet through the platform.
08Recruiting and Athletic Opportunities
NextUp may help athletes showcase their experience and connect with the sports community, but NextUp does not guarantee recruiting opportunities, roster positions, scholarships, employment, representation, admission to any school or program, or any other athletic outcome.
Information provided through NextUp should not be interpreted as a promise of any particular athletic, academic, recruiting, or professional result.
09Third-Party Services
NextUp may contain links to or integrations with third-party websites and services.
NextUp does not control and is not responsible for third-party services, their content, availability, or practices. Your use of third-party services may be governed by separate terms and privacy policies.
10Intellectual Property
NextUp and its software, branding, designs, logos, graphics, platform features, and other materials provided by NextUp are owned by or licensed to NextUp Labs, LLC and are protected by applicable intellectual property laws.
These Terms do not grant you ownership of NextUp’s intellectual property.
You may not copy, reproduce, modify, distribute, sell, or commercially exploit NextUp’s proprietary materials except as permitted by us or applicable law.
11Suspension and Termination
You may stop using NextUp at any time and may request deletion of your account, subject to applicable retention requirements.
We may suspend, restrict, or terminate access to NextUp if we reasonably believe an account violates these Terms, creates a safety or security risk, is being used fraudulently, or could harm NextUp or its members.
12Changes to the Service
NextUp is an evolving platform. Features, functionality, account types, eligibility requirements, pricing, and other aspects of the service may change over time.
When changes materially affect your rights or obligations, we will provide notice when required by applicable law.
13Disclaimers
NextUp is provided on an “as is” and “as available” basis to the extent permitted by applicable law.
We work to provide a reliable and useful service, but we do not guarantee that NextUp will always be available, uninterrupted, error-free, or free from security vulnerabilities.
Nothing in these Terms excludes rights or protections that cannot legally be excluded.
14Limitation of Liability
To the fullest extent permitted by applicable law, NextUp Labs, LLC and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of NextUp.
Additional limitations may apply depending on applicable law.
15Changes to These Terms
We may update these Terms as NextUp evolves or as legal requirements change.
If we make material changes, we will update the “Last Updated” date and provide additional notice when appropriate.
Continued use of NextUp after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
